Management - Lease of Apartment/ Agreement

Both parties herein have agreed to the terms below;
1 - The Owner herein agrees to grant to Ray Sperring and the website
HAC, and OCS Goldcoastregion a Permanent ongoing Lease on Unit
2 69 Garfield Tce Surfers Paradise - , QLD 4217 “Apartment” with
all fixtures and further grants authority to subrent the apartment.
The owner further agrees to authorise the OCS Relay Booking Office
to purchase out of revenue any required furniture and accessories
from time to time as mutually agreed.
2 - The owner will provide 4 sets of keys, and authorises the
Lessee to maintain 4 sets of keys –
3 - The Owner authorises the Lessee to pay for all Administration
fees from revenue - The Owner authorises the Lessee to pay
commission, and levy fees on the revenue (to cover meeting guests,
toiletries, soaps, detergents, linen, laundry, cleaning and housekeeping,
any minor breakages and repairs, lighting, minor plumbing blockages
insinkerator and toilet as well as the supply of accessories for
the Property Maintenance and Management) and a 5% levy from revenue
to cover Telemarketing Sales staff and Travel Agents referral fees.
Where the Owner generates the referral, the fee payable shall be
no more then 15%.
4 - The Lessee will subrent the unit as per the conditions outlined
in the booking sheet to the clients the agreed sum per night/week
as determined from time to time by the Lessee. Guests are required
to sign an agreement giving authority to use their credit card
to reimburse any breakage and losses involved in the apartment
payable through Aussie Tourism Holidays merchant banking facilities.
5 - All forward bookings must be honored - The Owner will give
to the GCR “Relay Booking Office” a minimum of 7 months
notice to terminate the agreement.
6 - In the event that the Owner/Management sells the Apartment
or terminates this agreement, the Owner/Management will assign
all of the Forward Bookings to the new Apartment owner, and or
will make available alternate accommodation for the clients and
if necessary the owner hereby agrees to refund to the public booking
client all rents received that have paid on any forward bookings
including the administration fee received by the Lessee as itemised
clause 3, and indemnifies the Lessee and this Relay Booking System
against any claims for any refund of rents that has been paid for
any booking.
7 - The Owner herein agrees to give unrestricted entry into the
property to effect the terms of this agreement and to pay any Body-Corp,
Rates, and Insurance Fees. The Owner also gives Authority to Lessee
and OCS Relay Booking Office to advertise the apartment on any
media, Internet website, News Paper, and or magazines.
8 - The Lessee and Booking Relay Office OCS agrees to pay into
the Owners Bank Account as listed herein net rent monies due on
a daily basis as receipted from the customers less any extra charges
for T/A travel agencies referral fees ($50 - $150 for long term
bookings ).. All Maintenance and Admin rents received by the Relay
Booking Office are Non refundable.
9 - The OCS Relay Booking Office will provide to the Owner an ID
number and Password to access and monitor all booking enquiries,
quotes and "Instant Availability Booking Calendar". As
the Lessee make replies at its discretion direct to the public
and provide quotes for the Owner/Management, the Owner may at its
discretion manage the "Instant Availability Booking Calendar" take
bookings, or liaise with the Relay Booking Office to accept bookings
after receiving availability from the OCS Relay Booking Office
System and Holiday Accommodation Cooperative Ltd.
10 – In the event the Owner whishes to use the Apartment
and is not available due to a booking, the Lessee will subject
to availability provide alternate accommodation into one of other
available apartments on a “pay for cleaning basis”
10 - If the Owner is acting as a self manager the Owner/Management
will amend on a daily basis the vacant dates to be filled in with
the online "Instant Booking Calendar" provided by. www.holidayaccommodationcooperative.com
website and affiliated websites, and the Owner hereby indemnifies
the Lessee, Ray Sperring , OCS Relay Booking Office System and
www.holidayaccommodationcooperative.com Holiday Accommodation Cooperative
Ltd against any claims from the Clients representatives and Bookers
for errors not corrected and or updated by the Owner in the "Instant
Booking Calendar" Holiday Relay Booking System for Holiday
Accommodation Cooperative Ltd.
11 - The Apartment owner further agrees that they are under a legal
binding Contractual Obligation to make their apartment available
to the client for the term that the Apartment has been booked for
rental. If this Agreement has been terminated prematurely or the
Apartment has been sold the Owner hereby agrees to either refund
all monies on demand back to the client as paid by the client in
full, or to relocate the client to an alternative suitable Apartment
Accommodation.
