1. To all Members, Venue Owners,Apartment Owners Accommodation providers,
and public customers booking enquirers; Access to and use of any information
or booking services on these websites is conditional on your acceptance
of these websites conditions without modification. Read them carefully-
print out and keep a copy of them for your future reference. If you do
not wish to accept any part of them, you must not use our websites or
use the OCS Holiday Rental and Booking Services, and Holiday Rental Relay
System.
2. In these Conditions, “you” and “your” means any

“Member” means property Manager or Property Owner, or Tourism
Operator, Tours, Transport, Theme Park owner, who may be the Member or
the lawful agent.
3. We provide you with a large variety of holiday homes, Units, Apartments,
Motels etc.and Tourism Theme Park tickets, and tourism allied industry
memberships and products, so that Accommodation Owners, and Members can
interact with other Members and book and pay online through a recognised
SSL socket encryption by Thawrt -
4 We accept no responsibility for the accuracy of the property details,
whether it be the description, the prices,the product, the terms or the
availability, or the conduct of the Owners of Apartments or Management
Rights in Venues - This is because all of this material is maintained
by the Member or owner using the software that we provide for them to
update their own particulars on our system..
5. We do initially check the details of every property and or product
upload for any obvious mistakes when they are first published, But you
must be aware that we do not always inspect the properties or interview
the Member who registers with us.
6. Please be aware that changes can be made to the property listing by
the Member at any time after the initial checking with or without our
knowledge. In order to give you the maximum protection and information,
we offer you and past customers the facility to review the property after
your stay. We have also developed our Index to be user friendly for your
convenience;
7. . We do our utmost to only offer Accredited Members to join us after
our initial registration is considered and we are satisfied that they
are capable of supplying the product they claim to sell but we cannot
be responsible for their conduct. - However, Please understand that UNITS
and Apartments for rental may be sold by an Owner or Withdrawn by the
Owner from the rental pool prior to a forward booking being satisfied.
When this happens we will do our best to relocate your booking with another
venue member of similar ranking. However, please note all Deposits and
Administration fees are non refundable, but may be credited against a
replacement venue and time period entirely at our discretion.
8. You are encourage to use the data base booking forms to gain
the best available price for your holiday accommodation. When
you make an application for availability, and your application
receives a "No Availability
reply" your details automatically roll over into our sandbox
where other holiday accommodation Provider Members/Owners can
access your details and may send you alternative quotes to use
their product.
9. . You must understand that if you make a booking using our OCS
(Owner Control System) wholesale
booking engine you are NOT booking with us - but direct with the
Member/Owner and your booking is subject to the terms of the Member’s
Owner Booking Conditions and deposit requirments, and at high
season times, they may not refund your payment if you cancell
your holiday accommodation booking - Our OCS holiday web booking
systems deduct a non-refundable admin fee- but this fee is transferred
over to another booking at another time to suit - There's
no Refunds for early departures. Owners may not refund any deposit
paid, and this website and it's affiliates are not responsible
to refund any monies paid for accommodation services.
10. This is typically the case when you book a holiday home from a magazine,
newspaper or website advertisement direct with the owner or agent. Where
we (Aussie Tourism Holidays) accept any deposit and or booking
administration fee , this fee payment is Non refundable, but may be transferred
to another venue if some double booking or other problem occurs that is
not by your fault and is provided at Aussie Tourism Holiday's services
discretion..
11. However we do provide you with greater information than most
because we offer you our Index and Customer Star Rating reviews
that are entirely independent opinions from past customers. -
Also our "Roll-over"
Sand box allows other venues to offer you their product. Any quoted rates will expire within 12 hours, if not immediately accepted by the client.
12. . Our liability to you extends solely to the correct functioning of
the booking system software, although the underlying pricing, discounting
and all other variable inputs to do with payment terms are controlled
by the Member/Owner and are therefore the Member’s/Owner’s responsibility.
13. All holiday accommodation bookings are also subject to the
Member’s
Booking Conditions. These will be shown when you make a price
quote or a booking request and are always available from your
Area once you are registered with us. Other than the non refundable
Admin and booking fee - You will be making your payment direct
to them according to their unique terms and conditions, You receive
this website's services at no extra costs over the providers rates
and the admin fees are deducted from the total amount quoted .
- . We provide members with a template so that Members can quickly
and easily create their own contracts. Each one however will be
customized according to the members preferences and you should
read them carefully.. This is the contract that you will need
to refer to should a problem arise and all complaints should be
directed to the Member in the first instance. When we accept any
Admin fee, a receipt email is returned to you and a copy of this
email with your requirments is sent to the Member/Owner so both
parties understand their respective "Contractual Obligations"
and responsibilities.
14. Nothing on this website constitutes an offer on our part. The items,
products services and matters detailed constitute an invitation to use
us as a relay booking office for you to make an order to the Apartment
Owners and Members of the Accommodation Buildings on the stated terms
to purchase the holiday
accommodation we feature for them.
The Members may accept or decline any such offer or order. All
accommodation featured or referred to is at all times prior to
specific confirmation subject to availability and no warranties,
promises or representations are given as to availability. NO prices
given are to be regarded as final until the FULL amount has been
paid. All prices are subject to change without notice. Members
or Owners may withdraw or amend prices or accommodation rates without
notice. We are unable to refund any monies that have not first
been refunded by the Owner. Member. Replacement or redirected accommodation
venues are considered and chosen by us at our descretion only.
All quotes expire after 24 hours. And there is no discounts for
early departures.
15. As a condition of your use of these websites and services , you warrant
to us that you will not use it or any material or information on it for
any purpose that is unlawful or prohibited by these Conditions. and all
material and photographs are copyright to our websites - You further warrant
that you are at least 18 years old and have the legal authority to use

18. Access to this website is conditional on your agreement that all information
contained in it and all matters which arise between you and us will be
governed by Queensland law. Access is further conditional on your agreement
that any dispute or matter which arises between you and us will be dealt

- Motor Vehicles provided in any accommodation packages for guests to
use as a courtesy car or loan car are supplied at the guests/driver's
responsibility only. The registered owner will not be held responsible
for any damages done to any other vehicles, or the vehicle provided for
the guest to use. The guest agrees to take full and all necessary responsibility
in the use of the vehicle and to pay for all running costs to maintain,
and the repairs needed as a consequence of using it.The Guest user of
the vehicle indemnifies the registered owner of the vehicle against all
claims for damages to third party vehicles and property or to any body
injuries to any person and subsequent liabilities real or implied.The
Guest user of the vehicle will pay an accident damage excess of $3000,
payable on demand.
19. No warranties, promises and/or representations of any kind,
express or implied, are given as to the accuracy or completeness
of any of the material or accommodation services or information
contained on this website or as to the nature, standard, suitability
or otherwise of any services or holiday

behalf of any Member(s). We shall not be liable for any loss or
